Legal Basis:

The FFG was founded on 1 September 2004 (pursuant to the FFG Acton establishing a research promotion agency, Federal Law Gazette I No.73/2004). The FFG is wholly owned by the Republic of Austria, represented by the Federal Ministry for Climate Action, Environment, Energy, Mobility, Innovation and Technology (BMK) and the Federal Ministry of Labour and Economy(BMAW). As a provider of funding services, however, the FFG also works forother national and international institutions.

II.   General information on data processing

We are strongly committed to providing an adequate level of protection for your personal data. We therefore comply with all applicable statutory provisions for the protection, lawful handling and confidentiality of personal data and data security, including but not limited to the Austrian Data Protection Act (DSG), the General DataProtection Regulation (GDPR) and the Telecommunications Act (TKG).

Personal data means any information relating to a data subject (natural person) who is identified or at least can be identified (e.g. name, email address or IP address).

As part of our electronic data processing, we commission IT service providers (data processors) who may gain access to your personal data in the course of their activities provided they need these data for carrying out their services. These service provider shave been obliged by us to take adequate technical and organisational measures to ensure the protection of your data. These service providers are not permitted to share your data (except in cases where this is required bylaw). 

III. Contact datamanagement

Purpose of processing:
The purpose of processing is the management of contact data and enquiries as well as communications within the framework of the Global Incubator NetworkAustria (GIN). In particular, your personal data will be processed for the purpose of contacting you, correspondence and the management of the programme.

Data categories processed
In particular, the following categories of personal data are processed:

·      Salutation
·      Title
·      First name
·      Surname
·      Company/Organisation
·      Department/Institute
·      Telephone number
·      E-mail address
·      Address
·      Other details and notes on the contact (type of contact, content of theenquiry, content of the conversation, date, etc.)
·      Associated Connections (programme, project, mentor, etc.)

Legal basis for processing:
Insofar as informed consent is obtained, Art. 6 (3) (a) GDPR is to be named asthe legal basis.

If the processing is necessary for the performance of a contract to which the data subject is a party or for the implementation of pre-contractual measures taken at the request of the data subject, Art. 6 (1) (b) GDPR shall be named  as thelegal basis.

In all other cases, the legitimate interest pursuant to Art. 6 (1)(f) must be named as the legal basis. There is a legitimate interest in the fact that contact data is managed centrally and effectively within the framework of the Global Incubator NetworkAustria (GIN).

Duration of storage:
Your personal data will be deleted as soon as the purpose of the storage and processing ceases to apply, provided that a legal obligation cannot be cited for the longer retention, or legal claims still exist that can be asserted against us and require retention.

Reference to the joint responsibility:
With regard to the processing in question, FFG and aws (www.aws.at/datenschutz) are jointly responsible  pursuant to Art. 26 GDPR. A corresponding agreement on joint responsibility has been concluded. If you have any questions regarding this joint responsibility, please contact the FFG.

IV.   Rights of data subjects

1.    Right of access
You have the right to request information about and access to all your personal data processed by the FFG.

2.    Right to rectification and right to restriction of processing
You have the right to request rectification or completion of inaccurate orincomplete data.

3.    Right to data portability
You have the right to request the FFG to provide you (or, where technically feasible, a third party designated by you) with a copy of your data in astructured, commonly used and machine-readable format.

4.    Right to erasure
You have the right to request the erasure of your data under certain circumstances, for example if they are not processed in compliance with dataprotection requirements.

5.    Right to object
You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Article 6 (1) (f) GDPR. 

6.    Right to withdraw the declaration of consent
You have the right to withdraw your declaration of consent under dataprotection law at any time.
The with drawal of consent shall not affect the lawfulness of processing based on consent before its with drawal.

7.   Complaint to the supervisory authority
Irrespective of the possibility to bring an action before a Regional Court (Landesgericht) pursuant to section 29 (2) of the Austrian Data Protection Actor of other remedies, if any, you shall have the right to lodge a complaint with the national supervisory authority in your place of residence if it is assumed that the processing of personal data is carried out unlawfully.

VI.    GIN GO AUSTRIA

GIN GO AUSTRIA (the “Program”), is supported by WhatAVenture GmbH (“dataprocessor”), a company registered at the Commercial Court Vienna, Austria under 581173t, whose registered address is Markhofgasse 19, 1030 Vienna on behalf of FFG. Start-ups, SMEs, and other companies (“applicants”, “you”) can apply to the Program and “pitch” your company. Applicants can then profit from the Program’s numerous benefits and broad network. The applicant’s personal data will be collected during this process.
